Section I – GE Identity Theft Protection
Legally Binding Terms. GE Identity Theft Protection with Notify Express (the "Product") from Signature Agency Inc. ("Signature") is administered by Intersections Inc. ("Intersections"). Signature is a member of the GE Financial family of companies and a part of the General Electric Company. Intersections is not an affiliate of Signature. Your acceptance of the Product constitutes your acceptance of these Terms of Use.
Ongoing Services. If you have ordered an ongoing service on a monthly basis, you authorize Signature to collect the monthly fee, at the then current rate, unless you cancel your membership by calling the number provided in your materials.
Your Use. You may use the Product only for non-commercial purposes. You may not use or order the Product for anyone else.
No Representations or Warranties. THE PRODUCT IS PROVIDED ON AN "AS IS" BASIS ONLY. SIGNATURE AND INTERSECTIONS DO NOT MAKE, AND EXPRESSLY DISCLAIM, ANY REPRESENTATION OR WARRANTY OF ANY KIND, WHETHER EXPRESSED, IMPLIED, OR ARISING OUT OF COURSE OF DEALING OR USAGE, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, NONINTERFERENCE WITH DATA, AVAILABILITY, OR THAT THE PRODUCT IS ERROR FREE. YOU ARE SOLELY RESPONSIBLE FOR ANY USE YOU MAKE OF THE PRODUCT OR ACTION OR DECISION YOU MAKE BASED ON IT.
Limitation of Liabilities. IN NO EVENT MAY SIGNATURE OR INTERSECTIONS BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE OR SIMILAR DAMAGES ARISING FROM OR RELATED TO THE PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES IN ADVANCE. SIGNATURE’S AND INTERSECTIONS’ TOTAL LIABILITY ARISING FROM OR RELATED TO THE PRODUCT MAY NEVER EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT.
Third Party Providers. The Product contains information provided by one or more credit reporting agencies, as identified in your materials. The Product may contain credit score analysis provided by one or more third-party providers, as identified in your materials. SIGNATURE AND INTERSECTIONS DO NOT CONTROL AND ARE NOT RESPONSIBLE FOR THE INFORMATION PROVIDED BY ANY CREDIT REPORTING AGENCY OR SCORE ANALYSIS PROVIDER.
Changes. Signature in its sole discretion may modify or cancel the Product, or change the fees, at any time without notice to you. Signature may modify these Terms of Use by posting the changes on the Product web site. The changes will be binding on you.
General. These Terms of Use are governed by the laws of the Commonwealth of Virginia, USA, exclusive of its choice of law principles. Any claim arising out of or relating to the Product shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association on an individual basis not consolidated with any other claim. Any party, however, may seek interim injunctive relief in a court of competent jurisdiction. Identity theft insurance is governed by additional terms and conditions stated in the certificate provided to you with these materials. These Terms of Use state the exclusive terms, conditions, representations and warranties governing the Product.
IMPORTANT INFORMATION ON REGULATIONS
The Fair Credit Reporting Act (FCRA) grants consumers important rights regarding consumer credit, credit files and related matters. Your specific rights are summarized below. You may have additional rights under state law.
- You must be told if information in your file has been used against you. Anyone who
uses information from a consumer reporting agency to deny your application for credit,
insurance, or employment -- or take another adverse action against you -- must tell you
and give you the name, address, and phone number of the agency that provided the
information.
- You can find out what is in your file. At any time, you may request and obtain your report
from a consumer reporting agency. You are entitled to free reports if a person has taken adverse
action against you because of information in a report; if you are the victim of identify theft or fraud; if
you are on public assistance; or if you are unemployed but expect to apply for employment within 60
days. In addition, you are entitled to one free report every 12 months from each of the nationwide
credit reporting agencies and from some specialized consumer reporting agencies. You may request
your report beginning on December 1, 2004, or on a later date, depending on where in the country
you live.
- You have a right to know your credit score. For a fee, you may request your credit score. In some
mortgage transactions, you will receive credit score information without charge.
- You can dispute inaccurate information with the consumer reporting agency. If you tell
a consumer reporting agency that your file has inaccurate information, the agency must
take certain steps to investigate unless your dispute is frivolous.
- Inaccurate information must be corrected or deleted. A consumer reporting agency or
furnisher must remove or correct information verified as inaccurate, usually within 30
days after you dispute it. However, a consumer reporting agency may continue to report
negative data that it verifies as being accurate.
- Outdated negative information may not be reported. In most cases, a consumer reporting
agency may not report negative information that is more than seven years old, or
bankruptcies that are more than 10 years old.
- Access to your file is limited. A consumer reporting agency may provide information about
you only to people with a valid need as determined by the FCRA -- usually to consider an
application with a creditor, insurer, employer, landlord, or other business.
- Identity theft victims and active duty military personnel have additional rights. Victims of identity theft have new rights under the FCRA. Active-duty military personnel
who are away from their regular duty station may file “active duty” alerts to help prevent
identity theft.

MA, VT, CO, MD, ME and NJ permit consumers to obtain one credit file per credit reporting agency per year, free of charge.
The Equal Credit Opportunity Act entitles you to be considered for credit regardless of race, color, age, sex, or marital status. The Act does not guarantee you will get credit; it ensures that the credit grantor must apply tests of creditworthiness impartially.
The Truth in Lending Act says that credit grantors must reveal the true cost of using credit; for example, they must disclose the annual interest rate you will be paying. In the case of a revolving credit card account, you must be told the periodic interest rate and the minimum monthly payment.
The Fair Debt Collection Practices Act protects you against threats from a debt collector and states that debt collection agencies must provide verification of any amount owed.
The Fair Credit Billing Act states that if you believe a bill you have received is in error, you may notify the creditor in writing within 60 days. The creditor must either correct the bill or send you an explanation within 90 days.

The information used by CreditXpert products is derived from one or more credit reports produced by the major credit reporting agencies, also called credit bureaus. The information contained in credit reports reflects the latest information provided to and recorded by the credit bureaus. Recent activity, such as making a payment, opening a new account or authorizing a credit inquiry, may not yet be reflected in the person’s credit reports. If not, this activity will not be reflected in any CreditXpert products. In addition, results may change every time new information is added to or removed from credit reports, as well as with the passage of time. CreditXpert products are only as accurate as the information upon which they are based. CreditXpert Inc. is not responsible for incorrect, missing or outdated information in credit reports, which may lead to inaccurate results. Users should carefully review all of the information in credit reports to make sure it is accurate and up-to-date. Note that CreditXpert Inc. does not provide financial or other advice, and is not a credit counseling or credit repair organization.
CreditXpert Credit ScoresTM are provided to help users better understand how lenders evaluate consumer credit reports. Lenders may use a different score to evaluate a person’s creditworthiness. Therefore, nothing in CreditXpert products is an endorsement or a determination of a person’s qualification for a loan, a change in loan terms or any other extension of credit by lenders. Each lender has specific underwriting standards, so a person should not assume that he or she will receive the same evaluation, credit terms or conditions from each lender. Also, CreditXpert Inc. is not connected in any way to Fair Isaac Corporation; the CreditXpert Credit Score is not a so-called FICO® score. CreditXpert Inc. does not represent that CreditXpert Credit Scores are identical or similar to any specific credit scores produced by any other company. Moreover, score changes predicted by CreditXpert products are only estimates. CreditXpert Inc. does not guarantee that credit scores from any other company will change by the same number of points, if at all.
Also, CreditXpert Inc. does not represent that potential problems found by its software in credit reports are real, or that correcting such items will result in changes to credit scores.
